Facts
On 25 July 2025, NHVR Authorised Officers intercepted a heavy vehicle in Bell Bay. The heavy vehicle was loaded with 12 boxes of fish and ice. The rear dual tyres were observed contacting each other by the Authorised Officers. The heavy vehicle was weighed on portable weight scales by the authorised officers and an offence was detected. The Defendant was charged with a breach of section 96(1)(c) HVNL – fail to comply with mass requirements (severe risk breach). The heavy vehicle's permitted mass on the drive axle was 7.2 tonnes, which was calculated on the tyre ratings. The vehicle’s alleged drive axle mass was 9.1 tonnes, an excess mass of 1.9 tonnes and is a 126.39% overload of the prescribed mass limit. The contravention of the vehicle's permitted drive axle mass resulted in a severe risk breach. By way of further context, the heavy vehicle’s permitted gross vehicle mass was also in breach. The permitted gross vehicle mass was 10.4 tonne and the alleged gross vehicle mass was 11.5 tonne. The driver who was employed by the corporation stated he did not know how much the load weighed and he had no idea what his axle mass limit was. This matter proceeded as a plea of guilty at the earliest opportunity, through a written guilty Plea. The Magistrate took into consideration the sentencing principles and the corporation had no prior criminal history.
