Facts
Between the dates of 6 February 2026 to 6 May 2026, heavy vehicles owned by the acuused Company were detected in New South Wales travelling between Safe-T-Cam sites in less than the allowable travel time. The accused Company is the registered operator and owner of a fleet of 12 heavy vehicles. Notices to Produce were sent to the registered operator of the vehicles identified by Safe-T-Cam. The registered operator failed to produce the required documents to the NHVR. The company has an extensive history of not replying to any notices sent by the Regulator. The Court said the objective seriousness of the offence was mid-range, and there was a need for general and specific deterrence.
