Facts

On 28 January 2025 a Mack tipper truck loaded with aggregate/soil registered to the accused was intercepted by NHVR officers for a compliance check at the Northern Road Heavy Vehicle Inspection Bay. The vehicle’s permitted mass on the second axle group was 20 tonnes and after the applicable mass adjustment, it was assessed at 25.5 tonnes, or an overload of 127.5%, falling into the severe risk category. The vehicle was also over on the gross with a permitted mass limit of 31 tonnes, it was assessed at 33.35 tonnes, or an overload of 107%, falling into the substantial risk breach. The driver was not aware of the permissible weight limits and had not received any instruction regarding axle or GVM weight limits. The site where the truck was loaded did not have a weigh bridge. The defendant failed to appear and the court granted the prosecution application to proceed ex parte. The court considered the matter as serious and there was no subjective material to consider given the defendant’s absence.
