Facts
The Defendant Company was the registered operator of a tray truck, that permitted the vehicle to be driven on the M1 Pacific Motorway at Mount White with a steer axle that was over mass. The permitted mass on the steer axle was 6.5 tonnes. The assessed mass of the steer axle was 8.74 tonnes or 134.5 % of the maximum mass permitted. The offence constituted a severe risk breach. The offence was caused by the load being placed too far forward on the truck tray. The Court noted the Company had no prior offences since operating in 2015 and this was a first offence, however, it was a big mistake. Incorrect loading puts pressure on the road. There is a need for specific and general deterrence. The Court noted the maximum penalty of $108,000, convicted the Company and brought the fine down to $21,000.

Educational point
Identify the mass requirements that apply to each heavy vehicle and communicate this to relevant staff, including loaders and drivers. Provide relevant staff the means to weigh or verify the weight of loads on heavy vehicles (e.g. on-board scales or portable scales). Ensure that all relevant staff are trained in mass, dimension and loading requirements. Prepare and provide pre-start trip inspection checklists that include mass and load inspection checklists. Prepare and provide load distribution plans to loaders and drivers.
As reported by NHVR.
