Facts
On 7 May 2024, a prime mover towing trailers was intercepted by SCOs at the Stirling North checking station. The vehicle was weighed and prime mover’s drive axle exceeded its permitted mass of 17 tonnes by 4.4 tonnes, an overload of 125%. The driver stated that he was not aware of the weight as he simply drove the pre-loaded vehicle. The company declined to be interviewed. The prosecution made submissions that this was a severe mass breach and that the corporate multiplier be applied to reflect the seriousness of the breach. The defendant’s history which involved previous offending for a dimension breach was brought to the court’s attention. The defendant stated that the vehicle was overloaded because the trailers were hitched the wrong way around and once this was addressed, the vehicle was allowed to continue its journey. The magistrate considered the submissions put by the parties. The corporate multiplier was applied and a significant penalty was imposed.
