Facts
On 25 February 2025, a NHVR Authorised Officer intercepted a heavy vehicle, a tipper travelling on Racecourse Road, Bairnsdale. An inspection was conducted of the heavy vehicle which revealed it was loaded with soil. The heavy vehicle's permitted gross vehicle mass was 7.5 tonnes. The vehicle's alleged gross vehicle mass was 9.1 tonnes, an excess mass of 1.6 tonnes and is a 121.33% overload of the prescribed mass limit, which is classified as a severe risk breach. The vehicle was not fitted with any onboard scales. Most notably, prior to the alleged offending, records indicated that the driver attended training, including training on load restraint and overloading prevention, on 1 June 2023 and 8 September 2023. The relevant training in respect of overloading prevention spanned 3 PowerPoint slides. Since the alleged offending, further training was conducted with the driver on 19 March 2025. The updated training records indicate that training had now been provided for wet bucket and dry loads, which was not covered in the previous training. In addition, the updated training had a detailed analysis of gross vehicle mass weight limits. The accused was legally represented and entered a plea of guilty at an early stage. The accused had no prior record. The legal practitioner for the accused made submissions that the soil was wet, which had increased the weight, and that the driver had not been sufficiently trained prior to the intercept.
