Facts
New South Wales Police intercepted a driver and it was found that the driver had breached HVNL Fatigue provisions on 18 occasions. The Defendant was the Operations Manager of the driver’s employer Company and a party in the Chain of Responsibility (CoR). An investigation into the employer Company was commenced by the NHVR during which it found that the Defendant failed to implement effective policies and procedures for the recruitment, training and management of the drivers they employed to conduct transport activities. It was found that the Defendant failed to take basic steps to ensure compliance by the drivers they hired and scheduled with HVNL fatigue provisions or to ensure that the heavy vehicles they operated were registered, in circumstances where they had the facilities to undertake appropriate monitoring of the fleet and drivers.
As reported by NHVR.
Penalty
- Fine
- $20,000
Fines under s 26H on the register: $20,000 to $217,500, median $65,000 across 5 matters.
Educational point
The legislative provision that the Defendant is charged with is aimed at those in charge of corporate entities to ensure that they take responsibilities for heavy vehicles to make sure we are all safe. The key issues are that general and specific deterrence are paramount, and there needs to be meaningful fines imposed to send a message to others, not just this offender.
As reported by NHVR.
