Facts
On the first day of operations at a new heavy vehicle safety station in regional New South Wales, inspectors intercepted a truck and trailer combination and found serious non-compliance. The vehicle exceeded its permitted length and was being operated without required safety features such as a functioning anti-lock braking system, roll-over protection and proper conspicuity markings. A subsequent inspection uncovered 43 mechanical defects – including extensive brake failures, cracked chassis components and loose fittings – which were described by an experienced officer as the worst he had encountered. The vehicle was grounded and had to be towed from the inspection site. In court, the operator pleaded guilty to breaching dimension limits and permitting an unsafe heavy vehicle to be used on the road. The magistrate found the conduct to be at the highest end of seriousness, noting the significant risks to public safety and infrastructure. Fines were imposed alongside a Supervisory Intervention Order (SIO).
