Facts
On 8 April 2025, a heavy vehicle towing a trailer was intercepted by NHVR authorised officers on the Newell Highway at Moree in New South Wales for a compliance check. The Accused is the registered operator of the vehicle. Authorised officers detected a mass breach on the third axle. The axle was assessed at 30.4 tonnes which was 10.4 tonnes in excess of the prescribed mass limit of 20 tonnes ie it was 152% of the allowable mass limit. The contravention constituted a severe risk breach. It was taken into consideration the early plea of guilty and the Accused was afforded the full 25% discount. It was also taken into consideration that the Accused has no history with the NHVR, however the offending is serious and poses a risk to public safety.

Educational point
Identify the mass requirements that apply to each heavy vehicle and communicate this to relevant staff, including loaders and drivers. Provide relevant staff the means to weigh or verify the weight of loads on heavy vehicles (e.g. on-board scales or portable scales). Ensure that all relevant staff are trained in mass, dimension and loading requirements. Ensure that all staff complete regular refresher courses in mass, dimension and loading requirements. Hold regular meetings, including Toolbox Talks, with staff. Ensure that all policies and procedures are up-to-date, and that all relevant staff are familiar with the policies and procedures. Prepare and provide pre-start trip inspection checklists that include mass and load inspection checklists. Prepare and provide load distribution plans to loaders and drivers. Develop and implement a mass sampling program (i.e. audit) to monitor mass requirements and your compliance
