Facts

On 21 June 2025 and 4 September 2025, NHVR Authorised Officers detected the same heavy vehicle exceeding mass requirements and dimension limits. On 21 June 2025, an axle mass requirement was exceeded by 121.33% placing it in the severe risk category. The vehicle also exceeded its gross mass in a minor risk category. On 4 September 2025, the vehicle was again detected to be over-mass on the same axle group in the substantial risk category at 107% of the maximum requirement. The rear overhang of the heavy vehicle was assessed at 4.7 metres which was 1 metre more than the prescribed rear overhang, constituting a severe risk breach. There was no appearance by the Defendant company at Court. NHVR submitted this was a dangerous operator with multiple convictions and penalty notices in recent times. There was a significant risk that the Defendant would continue to re-offend, indicating a need for specific deterrence. The Court gave no discount on sentence. The Court found pursuant to section 599 of the Heavy Vehicle National Law the Defendant was a systematic offender and specific deterrence was required. The Defendant was convicted and fined for all offences and a Supervisory Intervention Order (SIO) was made.
