Facts
Heavy vehicles owned by the defendant were detected travelling between Safe-T-Cam sites in less than the allowable travel time on 5 occasions from December 2025 to February 2026. Authorised officers of the NHVR issued Notices to Produce to the defendant requesting details of the drivers on each occasion, as well as copies of work diary records. The NHVR did not receive a reply to any of the Notices to Produce issued. The defendant’s lawyer appeared and entered a plea of guilty on behalf of the Company, submitting it was a small business and had learnt its lesson. Remedial steps had been taken to mitigate reoffending. The address had changed for NHVR to send future Notices. The information had been provided at a later date. Prosecution submitted the provision of information was too late. The Regulator is frustrated when Notice to Produce are not answered in time and is unable to take appropriate action at the time. The Court was satisfied remedial steps had been taken to prevent reoffending. The Defendant was given a 25% discount for early plea. The Court accepted financial hardship but denunciation and deterrence were needed.

Penalty
- Fine
- $16,000
Fines under s 569(2) on the register: $2,000 to $80,000, median $16,000 across 15 matters.
Educational point
Failing to respond to statutory notices impedes the Regulator’s monitoring and investigation of the industry. The Regulator will commence prosecutions where a party fails to produce evidence especially where the inaction shields a party from prosecution. The Courts treat these matters seriously.
