Facts

On 5 August 2025, Authorised Officers of the NHVR observed a heavy vehicle travelling on the Augusta Highway in Stirling North. Officers directed the vehicle into the Stirling North weighbridge for a compliance check. The Authorised Officers then intercepted the vehicle, spoke to the driver, and inspected the vehicle, its components, and its load. Charge one the Accused permitted a person to drive the vehicle from Cavan (South Australia) to Olympic Dam (South Australia). The vehicle's permitted tri-axle group mass was 20 tonnes. The vehicle's tri axle group mass was weighed at 26.080 tonnes. Taking into account the applicable mass adjustment, the vehicle's alleged mass was 25.580 tonnes, an excess mass of 5.580 tonnes, or an overload of 127.9%. The vehicle was loaded with powdered concrete mix. The contravention of the vehicle's permitted mass resulted in a severe risk breach. On 16 September 2025, Authorised Officers attended the premises of the Accused for the purpose of conducting an investigation into the incident on 5 August 2025. The Accused had been identified as the loader of the vehicle. The loader made admissions to the offending. The prosecution made standard submissions, including reference to section 594 of the HVNL. It was emphasised that the offending was serious in nature, particularly having regard to the risks identified in section 594; The prosecution further submitted that the Court should have regard to the objective seriousness of the offending and the importance of general deterrence The defendant, in their capacity as a loader, has an otherwise unblemished safety record, save for the present incident. The defence submitted that the incident was contributed to by the transport company, which failed to provide an appropriate truck for the load. Since the incident, the Accused has reviewed and revised all relevant procedures and has implemented new procedures and staff training to ensure that such an incident does not occur again.
