Facts
On 28 July 2025 authorised officers from the NHVR observed the Defendant’s rigid truck travelling on Prospect Highway, Pemulwuy, New South Wales. The vehicle, with a GVM of 23.5 tonnes, was directed to an inspection station for a compliance check. Upon inspection, it was found that the Defendant had permitted a driver to operate the vehicle in excess of the permitted first axle mass limit. The applicable limit was 6.5 tonnes; however, the axle mass was measured at 8.2 tonnes (adjusted to 7.9 tonnes), resulting in an excess of 1.4 tonnes (121.54%). The vehicle was carrying building materials and supplies. This constituted a severe risk breach under the mass requirements. The matter was heard before the Fairfield Local Court on 29 April 2026. The Defendant entered a plea of guilty and consented to the NHVR’s Supervisory Intervention Order (SIO). Defence tendered material outlining the proposed SIO, with an estimated cost of $636,000 plus associated expenses, and submitted that any penalty should be dealt with under section 602 of the HVNL. The Prosecution emphasised the considerations under section 594 of the HVNL, particularly the implications and risks associated with mass breaches, and noted the Defendant’s significant offending history. The Defendant was convicted and imposed a fine of $8,800, which was suspended pursuant to section 602 of the HVNL. A 12-month SIO was also granted, with obligations imposed on the Defendant.
