Facts
On 22 January 2024, Authorised Officers were flagged down at Taree Waste Management Centre due to an overloaded heavy vehicle that had exceeded the maximum weight on the weighbridge. The officers weighed the heavy vehicle with portable scales, and it was ascertained that the assessed gross mass of the vehicle was 60.15 tonnes, an excess mass of 16.65 tonnes or 138% of the maximum permissible mass. Both the drive axle group and the rear tri-axle group were also found to be over mass in a severe risk category. The vehicle was loaded with deceased turkeys and dirt. It was noted the Defendant Company was an exemplary corporate citizen with no offences in 35 years. It had 20 trucks and 30 local employees. It had now taken steps to ensure the offending will not happen again and prospects for rehabilitation were good. The risk factors in section 594(2)(c) of the HVNL were considered and there was a need for general deterrence. Noting the maximum penalty and the Defendant Company was entitled to a 25% discount for the early plea of guilty, a conviction was recorded and the Defendant Company was fined $10,000.
