Facts
The corporate accused in this matter was charged as a loader and is a global leader in shipping of containers. The accused owns container yards, in which the heavy vehicle was loaded at a container yard in Altona North. On 14 September 2024, NHVR authorised officers attended an intersection in Altona North. The heavy vehicle had lost its load. At the scene two of four flat rack containers were dislodged from the trailer of the heavy vehicle. The flat rack containers damaged the leg of the street sign and chevron markings. Investigations revealed that the loader failed to comply with its loading requirements as two of the flat rack containers were dislodged due to not being secured by twist locks by an employee of the corporate accused, prior to the departure of the load. This was a breach of section 111(1)(c) HVNL – fail to comply with loading requirements (severe risk breach). This matter proceeded as a plea of guilty at the earliest opportunity. The accused through their legal counsel noted that there was a breakdown of procedure and that the procedures had been updated shortly after. The Magistrate noted in sentencing remarks that this was a serious example of a breach of this offence. But for the plea of guilty, the penalty that would have been imposed would have been a fine of $30,000 with Conviction. The corporation had no prior criminal history.
