Facts
On 26 November 2023, an NHVR Safety and Compliance Officer conducted a compliance check on a heavy vehicle at the eastbound checking station on the Princes Highway, Monteith. The vehicle, comprising a rigid truck towing a trailer, was loaded and found to be 21.50 metres in length, exceeding the prescribed limit of 19.00 metres by 2.40 metres, constituting a severe risk breach under the Heavy Vehicle National Law (HVNL). The driver admitted the measurement and stated that they were directed by their employer to operate the vehicle. A representative from the company provided a South Australia Class 3 Mass and Dimension Exemption Notice; however, the officer deemed the vehicle ineligible due to non-compliance with the definition of "Dog Trailer" under the Heavy Vehicle National Regulation. The driver had not measured the vehicle before driving; corrective action was directed by the officer to adjust the load.
