Facts

On 15 May 2026 NHVR Authorised Officers intercepted a rigid truck towing a trailer at the Twelve Mile Creek Heavy Vehicle Safety Station for a compliance check. The defendant was the driver of the vehicle. The defendant produced their National Driver Work Diary, and NHVR officers identified two occasions where the defendant had made false or misleading work diary entries, where they recorded resting when the heavy vehicle was sighted by road safety cameras travelling on the road. The defendant was charged with two counts of making false or misleading work diary entries. The Court noted these offences were serious examples due to deliberately making a false record to get around fatigue laws. The defendant had recorded rest when the vehicle was detected driving by camera. The Court noted the defendant had a poor traffic record but no prior HVNL offences.

Educational point

Consider implementing Electronic Work Diaries for all drivers of fatigue-regulated heavy vehicles. Ensure all drivers have completed relevant training in fatigue management and that regular refresher courses are completed. Prepare and provide driver realistic schedules which include suggested break times and locations to ensure compliance with work and rest break requirements.
