Facts

On 20 November 2025, the defendant was intercepted by NHVR officers in Cloncurry, Queenlsand, driving a heavy vehicle in an A-triple combination. The officers conducted a check of the driver's National Driver Work Diary which identified that they were regularly transporting freight into and out of the Northern Territory from Queensland. Variances were identified in the vehicle odometer which the defendant had recorded upon commencing a rest break to when they recommenced work after the rest break. NHVR officers obtained manifest documents, trip sheets and driver work diary records from 20 October to 20 November 2025 which confirmed the defendant was the sole driver and demonstrated that the defendant had transported items of freight to various locations in Darwin and surrounding suburbs during periods of time when they had recorded themself as resting in their work diary.

Educational point

Section 16 of the HVNL makes it clear that it is the intention of the Queensland Parliament that this Law includes acts done outside the territorial limits of Queensland. This reinforces the national nature of the regulatory scheme as applying to heavy vehicles which traverse jurisdictional borders. False entries, whether inside or outside the jurisdiction, should never be made in written work diaries and produced to NHVR’s authorised officers.
