Facts

An Authorised Officer asked for the production of a heavy vehicle driver’s work diary. After initially contending they were not carrying one, the driver produced a work diary when the vehicle was to be searched. On inspection, 26 work-diary related offences were detected by the Authorised Officer on 39 pages between February and October 2025. The offending occurred as a result of the driver repeatedly failing to complete the information required for their daily work diary entries including omitting to record vehicle registration numbers, dates of entry, total work and rest times, information relating to activity changes between work and rest such as location and time, odometer readings, and details in relation to driving two up with another driver and their work and rest changes. The driver also failed to provide 35 duplicate diary copies to their record keeper and had removed four pages from their work diary. The driver confirmed the diary was theirs, but claimed not to know how to use it and had never received any formal training. They said that they did not provide yellow copies to their record keeper. Following the intercept, the driver was issued with a direction to rest for 24 hours as the incomplete records meant their levels of fatigue could not be reliably assessed.
