Facts

On 3 January 2025, a rigid truck registered to the Accused, and with a GVM of 10.4 tonnes, was detected travelling northbound on the M1 at Mount White. The vehicle failed to divert into the Mount White South Heavy Vehicle Safety Station as required. On 7 January 2025, the National Heavy Vehicle Regulator issued a Notice to Produce to the Accused, requesting details of the driver at the time of the offence, with a response due by 28 January 2025. No response was received. A second Notice to Produce was posted to the Accused’s ASIC-registered address on 25 March 2025, requiring a response by 8 April 2025. Again, no reply was received. The Accused has HVNL history, having been convicted on 3 February 2025 at the Parramatta Local Court for the same offence and fined $10,000. The Accused failed to appear, and an ex parte application was made. The ex parte application was granted, and no submissions in mitigation were made.

Educational point

Operators must ensure they maintain up-to-date records of vehicle use and driver details. Operators must ensure that they have formal processes for mail handling, compliance checks and responding to the Regulator. Ensure that all policies and procedures are up-to-date, and that all relevant staff are familiar with the policies and procedures. Operators are required to keep postal and registered addresses updated, including with ASIC. Failure to do so places a company at risk of enforcement action and fines.
