Facts
On 6 November 2025, Authorised Officers of the National Heavy Vehicle Regulator detected an Isuzu heavy vehicle travelling Southbound on Hume Highway, Marulan, New South Wales. The vehicle failed to divert off the highway and enter the Marulan South Heavy Vehicle Safety Station. The vehicle had a GVM of 10.4 tonnes. On 13 November 2025, NHVR sent a Notice to Produce to the Accused who was the registered operator, pursuant to s570 HVNL requesting the driver details. No response was received. On 19 December 2025, NHVR sent a second Notice to Produce to the registered operator requesting the driver details. After multiple correspondence between NHVR and the Accused, the Accused failed to respond to the Notice to Produce by the 16 January 2026. A guilty plea had been entered previously. The Court considered s594 HVNL considerations, subjective material tendered from the Director, considered objective seriousness, applied 25% discount for early plea, and found the offence proven.
As reported by NHVR.
