Facts
On 2 June 2024 at 7:31pm authorised officers of the NHVR detected a heavy vehicle travelling on Pacific Highway A1 which failed to enter the 12-Mile Heavy Vehicle Safety Station. On 4 June 2024, authorised officers sent a Notice to Produce to the registered owner of the vehicle requesting the name and residential address of the driver of vehicle on 02 June 2024 at 7:31pm. The registered operator was required to reply within 21 days. The NHVR did not receive any reply to the Notice to Produce dated 04 June 2024. On 24 July 2024, authorised officers sent a second Notice to Produce to the registered owner of the vehicle. The registered operator was required to reply within 14 days. The NHVR did not receive any reply to the second Notice dated 24 July 2024. The matter was before the Parramatta Local Court on the 07 April 2025. There was no appearance by the accused. The Magistrate granted leave to have the matter heard by exparte after proof of service was tendered.
