Facts
On 10 September 2022, authorised officers of the NHVR observed a heavy vehicle travelling on the Hume Highway at Marulan in New South Wales in excess of its permitted width of 2.5 metres. The vehicle's width was measured at 2.955 metres, which placed it in the “severe category”. After a prosecution was commenced, the Defendant proposed an Enforceable Undertaking (EU) which was accepted by the Regulator, and on 10 October 2023, the charge before the Goulburn Local Court was withdrawn. On 10 October 2024, the EU with the accused expired. The Company had failed to comply with a number of required actions. The NHVR subsequently charged the Company with failing to comply with the EU. The matter was finalised at Parramatta Local Court on 1 September 2025 after a plea of guilty was entered. The Defendant submitted that for part of the period of the EU it had been in administration. It was noted that the company has since come out of administration, was a relatively small operation with six employees, and expressed remorse for the incident. New business practices were said to have been introduced to minimise the risk of similar offences occurring in the future. The NHVR highlighted that the EU activities remained outstanding and had not yet been complied with, and raised concerns about the significant safety risks involved. The Local Court acknowledged the seriousness of the current offence, the maximum penalty for the breach, and held that it was necessary to impose a substantial fine to deter the defendant from future reoffending and serve as a general deterrent to others in the industry.
