Facts

On 7 October 2024 a Nissan rigid truck failed to enter the Twelve Mile Creek Heavy Vehicle Safety Station. The registered operator was served with two notices to provide the Regulator with information which would identify the driver of the vehicle, however no response was received. The registered operator had no offence history. The registered operator was charged and served with a Court Attendance Notice to appear before the Parramatta Local Court on 20 October 2024. The defendant failed to appear and the court determined the proceedings exparte. There was no communication from the defendant on the court file and the court was satisfied that service had been effected. The maximum penalty of $40,000 was taken into account and agreed with the prosecution submission that general deterrence was necessary.

Educational point

s 315 of the HVNL extends liability to the registered operator of a heavy vehicle to ensure record keeping compliance. Registered operators must ensure that the record keeper records the information as set out in subdivisions 1, 2, 3 and 4 of Division 3 Part 6.4. Registered operators must promptly comply with requests made by the Regulator for information about a heavy vehicle, or personal details about the driver of a heavy vehicle. Registered operators should follow up with the Regulator after receiving a request for information, to ensure that the information or documents have in fact been received by the Regulator.
