Facts
The defendant was intercepted by NHVR officers on the Augusta Highway at Port Augusta on 25 August 2025. Upon inspection of the defendant’s work diary, the officers identified that on 13 August 2025 the defendant had recorded rest when they had been working. When asked why the defendant had made this false or misleading entry, the defendant said words to the effect of, “Just do me for it and get it over with”. The defendant had a history of HVNL-related offending, and their attitude and statements to the officers during the intercept demonstrated ongoing non-compliance. Prosecution made an application for a Supervisory Intervention Order (SIO) for the defendant to use an Electronic Work Diary (EWD) for a period of 12 months to address the defendant’s non-compliance. The Court had regard to the defendant’s prior offending and their attitude of non-compliance by reference to how they spoke to the officers during the intercept. They considered the defendant to be a systematic or persistent offender and the terms of the SIO sought appropriate to address the defendant’s ongoing non-compliance with the HVNL.
