Facts

On 17 June 2025, Authorised Officers from the National Heavy Vehicle Regulator intercepted a heavy rigid truck on two separate occasions at Eastern Creek, New South Wales. First Intercept – Approximately 8:37am The driver was unable to produce a driver’s licence. They verbally identified themself and their identity was later confirmed through Transport Authority records. Records showed their licence had expired, they were disqualified, and they had a recent prior conviction for driving while cancelled/refused. They had not re-applied for a licence after the disqualification period ended. The driver stated they did not know their licence was cancelled and no longer lived at the recorded address. Officers issued the driver with a written cancellation/suspension/withdrawal notice, which they signed acknowledging they understood it was an offence to drive while cancelled. Second Intercept – Approximately 9:21am About 20 minutes later, officers again observed the same individual driving the same heavy vehicle. The driver admitted they knew it was an offence to drive while cancelled and had continued driving despite receiving the earlier notice. They provided no lawful justification for doing so. Officers issued a second written notice, which the driver again signed acknowledging the offence.

Educational point

Ensure that your licence is valid before driving any motor vehicle. Ensure address and contact details are up to date with the relevant Traffic Authority to ensure that all official notices regarding one’s licence status are received. If licence is cancelled, you must ensure that you do not drive until the cancellation period has ended and you have ensured your licence has been lawfully reinstated through the proper application process with the relevant Transport authority. Failing to ensure these requirements can lead to heavier penalties, extended disqualification periods, and serious legal consequences.
