Facts
On 28 September 2020 at Tenandra, an excavator sieve bucket weighing approximately 400 - 500 kgs fell 2.4 metres from a trailer to the ground. A 70 year old truck driver and labourer was fatally injured and another labourer was seriously injured. After a SafeWork NSW investigation, the company was charged with a breach of 32/19(1) of the Work Health and Safety Act 2011. The District Court convicted the company and fined it $450,000 on 31 August 2023.
